Pretoria Registrar's Circular 19 of 2016 (attached hereto for ease of reference) provides clarity on the uncertainty of using the word "THE" in the name of a Trust.
 
Kindly have yourself led by the Trust Deed and should an already registered deed be faulty, the provisions of section 4(1)(b) of the Deeds Registries Act 47 of 1937 must be applied to effect the rectification. The said amendment can be brought by the conveyancer appointed in the power of attorney, provided the necessary letters of authorisation are lodged to prove the correct name. Kindly note that the letter of authorisation must be certified as a true copy by the Master
